1. Acceptance of Terms

By accessing or using the website located at windsorfences.com (the "Site"), requesting a quote, signing a service agreement, or engaging Precision Windsor Fences for any work, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use the Site or our services.

These terms apply to all visitors, customers, and others who access or use the Site or engage our services.

2. Description of Services

Precision Windsor Fences provides residential and commercial fencing services in Windsor, CA and surrounding areas of Sonoma County. Services include but are not limited to fence installation, fence repair, fence replacement, gate installation, and custom fence design.

All services are subject to availability, scheduling, and the execution of a written service agreement between the customer and Precision Windsor Fences prior to commencement of work. Nothing on this Site constitutes a binding offer or contract for services.

3. Estimates and Pricing

All estimates provided by Precision Windsor Fences are based on information available at the time of the on-site visit and are valid for 30 days from the date issued unless otherwise stated in writing. Estimates are not binding contracts.

Final pricing is confirmed in a written service agreement signed by both parties before work begins. The price in the signed agreement is the price you pay, subject to the following exceptions:

• Unforeseen site conditions discovered during work (such as buried obstructions, unmarked utilities, or soil conditions not apparent during the estimate) may result in a revised price. We will notify you before proceeding with any work that would change the agreed price.
• Customer-requested changes to the scope of work after the agreement is signed will be documented in a written change order and priced separately before that work begins.
• Material price increases due to supply chain changes beyond our control may be passed through to the customer only with advance written notice and your written approval.

4. Scheduling and Cancellation

Work is scheduled after a signed agreement and any required deposit are received. Start dates are subject to weather, permit processing times, and material availability. We will provide you with a confirmed start date and notify you of any changes as soon as possible.

If you need to cancel or reschedule a confirmed appointment, please contact us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a rescheduling fee to cover crew scheduling costs. Any deposit paid is non-refundable if work has already been mobilized or materials have been ordered specifically for your project.

Precision Windsor Fences reserves the right to reschedule work due to weather conditions, safety concerns, or circumstances outside our control. We will notify you promptly and reschedule at the earliest available time.

5. Payment Terms

Payment terms are specified in your written service agreement. Standard terms require a deposit at the time of signing, with the remaining balance due upon project completion. Final payment is due on the day the work is completed and the final walkthrough is conducted, unless otherwise agreed in writing.

Accepted payment methods are stated in your service agreement. Balances not paid within 10 days of the due date may be subject to a late fee. Precision Windsor Fences reserves the right to pursue collection of unpaid balances, including reasonable attorney fees and court costs if legal action becomes necessary.

6. Customer Responsibilities

Before work begins, you are responsible for:

• Ensuring the work area is accessible and clear of vehicles, equipment, stored items, plants, and pets.
• Providing accurate information about the property, including known underground utilities, irrigation lines, and property boundaries.
• Confirming that required HOA approvals, if any, have been obtained prior to the start of work.
• Ensuring that any required permits are in place. Precision Windsor Fences will apply for required permits as part of the service agreement where indicated, but the customer is responsible for providing accurate property information needed for permit applications.

Delays or additional costs caused by inaccurate information, inaccessible work areas, or missing approvals are the responsibility of the customer.

7. Warranty Disclaimers

Precision Windsor Fences warrants that work will be performed in a professional and workmanlike manner in accordance with the written service agreement. Specific warranty terms, if any, are stated in your service agreement.

Except as expressly stated in a written service agreement, all services and materials are provided "as is" without additional warranties of any kind, express or implied. We make no warranty that any fence or installation will be free from future damage caused by weather, soil movement, acts of nature, impact, vandalism, or normal wear and tear.

Material warranties, if available, are provided by the manufacturer of the materials used and are subject to the manufacturer's terms and conditions. Precision Windsor Fences does not extend manufacturer warranties beyond what the manufacturer provides.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Precision Windsor Fences shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to the use of this Site or the performance of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from a project shall not exceed the total amount paid by you to Precision Windsor Fences for that project.

Precision Windsor Fences is not responsible for pre-existing conditions on your property, including but not limited to underground utilities not disclosed to us, structural issues not visible during a standard site visit, or property encumbrances.

9. Site Content and Accuracy

The information on this Site is provided for general informational purposes only. While we make reasonable efforts to keep the Site accurate and current, we make no representations or warranties about the completeness, accuracy, or reliability of any content on the Site. Pricing, availability, and service details are subject to change without notice.

10. Dispute Resolution

If a dispute arises between you and Precision Windsor Fences related to our services, we encourage you to contact us first at contact@windsorfences.com or (707) 687-4981 so we can attempt to resolve it informally.

If informal resolution is not possible, any dispute shall be submitted to binding arbitration in Windsor, CA under the rules of the American Arbitration Association, unless both parties agree in writing to another method. The arbitrator's decision shall be final and binding. You waive any right to a jury trial or to participate in a class-action lawsuit.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in California.

12. Modifications to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will post the revised version on this page and update the effective date at the top. Your continued use of the Site or our services after any change is posted constitutes your acceptance of the revised terms.
